The Terms of Use (or “TOU”) is an agreement between a user and Cortexia Health, Inc. (“Cortexia Health”). There are rules a user agrees to follow when using our websites, online medical platforms, and mobile applications (the “Services”), including any services provided through the Services.

By using the Cortexia Health sites, the Cortexia Health Services, or interacting with us, you are agreeing to these Terms of Use. Please read the following carefully.

I. Consultation Service

Please be aware that any consultation service, medical opinion, or healthcare advice provided through the Services by participating physicians or specialists is subject to applicable professional regulations and terms. Statements, medical opinions, or services accessible through Cortexia Health are provided in accordance with our system workflows and applicable agreements. Third-party content, linked sites, or external resources accessed through the Services are not endorsed or warranted by Cortexia Health.

II. Children's Privacy

The Services are intended for adult users. We do not knowingly collect personal information from children without appropriate parental or legal guardian consent as required by applicable law.

III. An Account and a User's Use of the Services

To access certain features of the Services, users must create a Cortexia Health account and maintain accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

IV. Internet Access May Be Required

To access the Services, compatible hardware and reliable internet access may be required. You are responsible for any data fees or connectivity charges incurred from third-party telecommunications providers when accessing Cortexia Health.

V. A User's Content and Records

We don’t claim ownership of the content or medical records you upload to the Services. You retain ownership of your personal information and health records, subject to the rights and licenses granted to Cortexia Health to process and transmit such data to deliver the requested Services.

VI. Intellectual Property

All software, trademarks, service marks, logos, brand features, designs, and content provided by Cortexia Health on or through the Services are the intellectual property of Cortexia Health, Inc. or its licensors. Unauthorized copying, modification, or distribution is strictly prohibited.

VII. International Users

We make no claim that the Services or content are appropriate or available for use in all locations outside the primary operating jurisdictions. Users who choose to access Cortexia Health from international locations do so on their own initiative and are responsible for compliance with local laws.

VIII. Indemnification

A user agrees to indemnify, defend, and hold harmless Cortexia Health, Inc., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses arising out of or in any way connected with user’s access to or misuse of the Services.

IX. Changes to this Agreement

Cortexia Health reserves the right to modify or update these Terms of Use at any time. We will post the revised terms on this page with an updated “Last Updated” date. Continued use of the Services following such modifications constitutes acceptance of the updated terms.

X. No Warranty

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Cortexia Health expressly disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

XI. Liability Information

To the maximum extent permitted by applicable law, Cortexia Health, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to, use of, or inability to access or use the Services.

XII. Changes to the Services and Cancellation

Cortexia Health reserves the right to modify, suspend, or discontinue any portion of the Services or cancel user access at any time, with or without notice, in accordance with applicable policies and agreements.

XIII. General Legal Terms

These Terms of Use, together with the Privacy Policy and any other legal notices published by Cortexia Health, constitute the entire agreement between you and Cortexia Health regarding the Services. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
